Terms of Service

Effective date: September 20, 2026

These terms are being reviewed by a lawyer as Seven Seas grows, particularly the liability and governing-law sections. They accurately describe how the service works today, but aren't a substitute for professional legal advice. Questions? Contact us below.

1. Who you're contracting with

Seven Seas is operated by Franco Roca, trading as Seven Seas Ops, a sole proprietor based in Argentina ("Seven Seas", "we", "us"). You can reach us at contact@sevenseasops.com.

Subscription payments are processed by our payment partner, Paddle, which acts as the merchant of record for those transactions and is the seller of record on your receipt.

2. Acceptance of these terms

By creating an account or using Seven Seas, you agree to these Terms of Service on behalf of yourself and, if applicable, the dive shop, charter operation, surf school, or liveaboard ("shop") you represent. If you don't agree, don't use the service.

3. What Seven Seas is

Seven Seas is operations software for water sports operators: bookings and manifests, checklists, gear and equipment tracking, crew scheduling, digital waivers, and cash-up tools. Seven Seas is a software tool, not a dive safety authority, certifying agency, or legal advisor — shops remain fully responsible for their own operational, safety, and legal decisions.

4. Accounts

You're responsible for the accuracy of information your shop enters, for keeping staff login credentials secure, and for any activity under your account. Seven Seas is intended for legitimate business use by water sports operators, not personal or unrelated use.

5. Your data

Guest, waiver, gear, and booking data your shop enters belongs to your shop. Seven Seas acts as a data processor for that information, as described in our Privacy Policy, not as its owner. You're responsible for having a lawful basis to collect and store the information you put into Seven Seas about your guests and staff.

6. Waivers — important limitation

Seven Seas provides tools to collect, store, and export digital or paper-backed liability waivers. Seven Seas does not collect or store medical or health information about your guests. Medical declarations stay on paper with your shop; the app records only whether a guest was cleared to dive, who recorded it and when. Seven Seas does not draft, review, or guarantee the legal sufficiency or enforceability of any waiver, template, or questionnaire in any jurisdiction. It's your responsibility, as the shop, to use waiver wording that's appropriate and enforceable for your activity and location, and to have it reviewed by your own legal counsel. Seven Seas is not a party to the waiver signed between your shop and your guest, and assumes no liability arising from a waiver's content or a guest's participation in your activities.

7. Acceptable use

8. Subscription and billing

New shops get a 15-day free trial with no card required. After that, subscriptions are paid by card through the checkout on our website, processed by Paddle as merchant of record. Plans are billed monthly or annually, renew automatically until cancelled, and are priced per boat rather than per user. Every plan includes unlimited staff accounts for normal operations; if the number of staff accounts on an account becomes disproportionate to the scale of the operation, we'll get in touch to agree on a suitable plan rather than restricting access without warning. You can cancel at any time from Settings → Billing → Manage billing. See our Refund Policy for how cancellations and refunds work. Nothing here should be read as a guarantee of current pricing indefinitely; we'll give notice of any price change that affects an existing subscription.

9. Termination

You can stop using Seven Seas and request deletion of your shop's account at any time by contacting us. We may suspend or terminate accounts that violate these terms, misuse the service, or fail to pay for an active subscription.

10. No warranty

Seven Seas is provided "as is." We don't guarantee the service will be uninterrupted, error-free, or fit for a particular purpose, though we work to keep it reliable. Offline features cache data locally and sync when reconnected, but we're not responsible for data entered while offline that's lost before it syncs due to device issues outside our control.

11. Limitation of liability

To the maximum extent permitted by law, Seven Seas' total liability for any claim relating to the service is limited to the amount your shop paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages, including lost bookings, lost data, or business interruption. Nothing here limits liability that can't legally be limited.

12. Indemnification

Your shop agrees to indemnify Seven Seas against claims arising from your use of the service, your interactions with your own guests or staff, or your violation of these terms — including claims related to waivers, injuries, or disputes between your shop and your customers.

13. Governing law

These terms are governed by the laws of Argentina, where Seven Seas is based. If that changes, we'll update this section and the effective date above.

14. Changes to these terms

We'll update the effective date above if these terms change, and post the updated version at this same URL. Continued use after a change means you accept the updated terms.
